Class Definition

All persons over the age of 18 residing at a residential property in the geographic area defined by the following addresses during the Class period, either by right of ownership or with permission from the property owner, or under the terms of a valid lease or rental agreement in force during that time.

Class Area

  • Newton Avenue, all residential addresses between Sampson & South 26th Street; (2200 to 2399 Newton Avenue, plus 2602 Newton which fronts on South 26th Street).
  • Sicard Avenue, all residential addresses between Newton & South 26th Street; (1025 to 1038 Sicard Avenue)
  • National Avenue, all residential addresses on the south side of National between Sampson & South 26th Street; (2200 to 2399 National Avenue, south side only, plus 2604 National (fronts on S. 26th))
  • South 26th Street, all residential addresses between Boston Avenue and Sicard Street, on both sides of S. 26th;
  • Sampson Street, all residential addresses between Newton Avenue and National Avenue, on the east side of Sampson Street only.

FAQs

1. I am a class member.  How do I receive payment? 

You must submit a completed and signed Claim Form by mail or email, and it must be postmarked (or received) no later than November 28, 2025.

In addition to the Claim Form, you must include proof of residency showing that you lived in the Class Area during the Class Period. Acceptable proof includes, for example, a lease or rental agreement, utility bill, mortgage statement, or government-issued identification showing your address and dates of residence

2. What proof do I need to submit with my Claim Form? 

You must attach at least one proof of residency showing that you lived in the Class Area during the Class Period (October 1, 2021 – December 31, 2023). Acceptable proof includes, but is not limited to:

  • Utility bill
  • Lease or rental agreement
  • Mortgage statement
  • Hospital or insurance billing statement
  • Copy of government issued ID

For Apex to accept your proof of residency, the proof must clearly state your name (which must match the name on the Claim Form) and must clearly state the address (which must match the address you list on the Claim Form).

3. What kind of documentation is sufficient to establish duration of residency?

Please note: the proof you submit must establish the full period you claim you lived in the Class Area. For example, if you claim residency from October 1, 2021 to October 1, 2022, your documents must show that you lived at the address for that entire period (not just part of it). You may submit more than one document to cover the full timeline.

Examples of sufficient documentation to establish duration include:

  • Lease or rental agreement showing the lease start and end dates.
  • Proof of rent payments (e.g., cancelled checks, ledger, bank/online statements) covering the entire lease term.
  • Utility bills listing your name and the address for each month (or the months) within the period you claim.

4. How much my payment be?

Payments will vary depending on:

  • How close you lived to the facility,
  • How long you lived in the Class Area, and
  • How many valid claims are submitted.
